
Sorry to alarm you but seriously…are you prepared to be on the defending side of a big lawsuit in 2009? You see with all of the foreclosures that have been inundating the market, many attorneys have been swamped dealing with loan modifications and foreclosure defenses.
As that market dries up a new, even more lucrative market may emerge based upon what we have been hearing. The market for lawsuits and actions against real estate agents and brokers who will be caught with their ever-loving pants down.
Heck, we wrote about these so-called short sale experts almost a year ago and told you it was going to be coming. But so many agents didn’t want to listen.Moreover, we also told you 10 months ago why real estate agents fail at short sales.
Now all of a sudden it is catching people by surprise that so many real estate agents are inept at short sales? C’mon…what’s the deal here? Well actually I am happy that some are finally willing to stand and call these posers out.
Especially when it’s prominent and respected Realtors who are beginning to call out the posers and tell them what’s up.
They wanted to take the easy way out and just follow the herd over the cliff submitting multiple offers to banks and trying to learn short sales on the fly. Now look at what will be staring them in the face.
Sure, anyone in the business knows that the NAR and local boards have worked hard to fend off liability for Realtors nationwide. This has been somewhat successful in regards to actions based upon contractual disputes and the like.
Hooray for Transactional Broker status!
However, an ominous cloud is forming over head and it’s getting somewhat dark in the sky for some Realtors who are painting themselves into a corner.
Here’s the scenario..the nightmare scenario. Have you noticed how many “Short Sale Experts” there are out there nowadays? It seems everywhere you look, there is another self-designated Short Sale Expert out there handing out his or her business card to some poor unsuspecting homeowner in distress.
A homeowner who wants to trust that they are indeed dealing with an “expert”. A homeowner who has been talking to and is now represented by the self-designated short sale expert.
Well, what happens when the homeowner loses the house and then the homeowner finds out that the agent wasn’t a short sale expert at all. In fact the so-called short sale expert has never even successfully completed a short sale..ever? Okay, I’ll spare you the wondering. The newly crowned expert has opened up a can of worms for gross misrepresentation and fraud.
Yep, it will be an easy case to win and you as an agent may be spending the rest of your career paying Mr. Distressed Homeowner for your gross negligence in your pitiful representation of him during the short sale process. Don’t be caught short!
You say this will never be proven. No one will be able to determine this? Well we spent an afternoon with an attorney and three of his paralegals recently and were amazed how easy it will be for them to pick and choose their targets.
There’s this thing called Google that you maybe aware of. Well, there is a feature that Google has which is pretty neat. You see you can take certain words and phrases and log them in and ask Google to notify you EVERYTIME this phrase is used ANYWHERE on the Internet.
So if there is an ambitious attorney he and his staff can set up this program to notify them ANYTIME the words “short sale” are used. Now this is where it gets interesting. When I was in their office we sat down and opened a file with over 900 notifications. 50 came in while we were sitting there.
They came from places like ActiveRain and other places where real estate agents congregate. My jaw dropped when I began reading what some agents were posting on ActiveRain and real estate blogs throughout the cyberworld.
Think this is not going to be a problem? Look around for yourself as to what some of these agents are saying in an open forum. Many are flat out saying that they don’t have any experience whatsoever and are just winging it. I don’t know about you but that’s not the definition of an expert in my mind and I don’t think it will be too hard for a judge and jury to agree.
How do you make sure you are not in the crosshairs of an attorney representing the interests of a homeowner with nothing to lose?
Simple…actually become an expert and learn how to perform short sales the right way . With so much opportunity and now with apparently so much liability for being inept, what is stopping you from actually learning the right way to execute a short sale .
So many will read this and only a few will have the opportunity to actually do something about increasing their income and limiting their liability.
Stop playing with fire and get yourself prepared to meet the challenges of 2009. Forget the past and move forward. Learn how to successfully execute a short sale and watch the investment in yourself payoff handsomely with increased commissions and profits.

Great post! It’s amazing how folks will put themselves out there with limited experience and maximized liability. I see similar behavior on Twitter. Folks just don’t seem to understand that once you release a “Tweet,” it becomes a searchable piece of the internet universe!
I got a phone call a few weeks ago from someone I thought was interested in my house. He spoke with an accent and asked several questions about the house. When I called the number back a few days later, the party did not speak with an accent. I got suspicious, so I googled the phone number and found out he was a realtor! He did not identify himself as a realtor. Should I report this realtor to the Board of Realtors?
I am also getting very tired of realtors who make cold calls to me, and no matter what company they are from, they all ask the same questions in the same exact order. What … are they all provided a script?
With all the properties listed in this horrible economy, why don’t they spend their time more wisely getting out there and selling those homes in order to stimulate the economy instead of: 1. calling me and misrepresenting themselves; 2. making an unsolicited call to me. If I wanted their services, I would call them.
