John, let me first state that you need to check with a lawyer. Now as to my opinion. Check the common law statute in your state. If it says that you are "legally married" even though you're not...then you may have a problem. Now the reality..most likely what she did was illegal. Anybody can record anything. You may need to have an attorney approach the courts to file an action to "quiet title" If she won't remove it then that's more than likely the way you will need to go.

And if you're feeling really spunky you may have an action to sue her pants of by filing a Slander of Title suit against her. But you are in a really serious situation and should contact a good lawyer and get it removed asap

My ex girlfriend placed a NOI on my house because we lived together and although I bought the house my self and also financed it in my name since we lived two years together and shared expenses and she spent money while living there when we broke up she felt intitled to my house? will it expire and could she win in court? John

Hmmm..interesting question. Let me look around and get back to you. In the interim I would check with some of the local real estate investment clubs in your area and see if 1) they have one and 2) if they are recordable in California. I wouldn't bother calling a Realtor unless they do a lot of work with investors as you will the usual blah, blah..blah about clouding title....
