Also, do I need to be in the same state to do assignment of contract or can I do it outside the state that I currently reside in? I guess I’m asking, is it possible to do assignment of contract without ever seeing the house or must I visit it ahead of time?

Hi Ted, for the most part, doing an assignment on a Short Sale is going to be pretty much out of the question. Not impossible, but highly improbable. As for the assignment fee being on the HUD, some will advise against it but there’s no reason not to put it on the HUD. Just make sure that assigning the contract is allowed per the terms of the Purchase and Sale agreement being assigned.

What if the property is a short sale and the investor have negotiated a short sale price with the mortgage holder on the sellers behalf. Dose the Assignment of Contract fee (POC) have to be noted in the HUD documents for mortgage holder and buyers lender to see or can it be a side contract between the investor and the buyer?
